Primary Homemaker Benefits In Minnesota
The primary homemaker benefit provides compensation to an individual who provides the majority of the household, homemaker or childcare duties in a family. You don’t need to prove that you go above and beyond for your family or your children in order to qualify, you only need to prove that you do the majority of the duties, or at least 51%. Some duties that may be considered to establish who is the primary homemaker in the family include:
- Cooking
- Cleaning
- Shopping
- Laundry
- Home Maintenance
- Child Care
This is far from a comprehensive list, but any actions around the house or for the betterment of the household could be used to establish your role as the primary homemaker.
Under Minnesota law, a primary homemaker who is unable to continue to provide some or all of these services while they recover from their car accident injuries is entitled to the “reasonable value” of those services. The value of these services will be established based on the current wage rates for someone hired to perform the same tasks. However, it’s worth noting that the maximum you can collect for homemaker services in Minnesota is $200 per month.
While the replacement cost of the services you perform around the house is probably greater than $200, these payments can certainly be of assistance as you get back on your feet after a car accident. It’s also worth noting that these payments will be made to the injured party, so while you will have to establish the need for replacement services because of your injury, the payments won’t be made directly to someone else who is helping you around the house. You’ll collect the benefits, and you can decide how that $200 is used for your family.
